These Terms of Service (“Terms”) govern the use of the website Omayna and the purchase of products offered through the online store.

By accessing this website or placing an order, you agree to these Terms.

If you do not agree with these Terms, you must not use the website.

By using this website, you also acknowledge that your personal data will be processed in accordance with our Privacy Policy, which explains how we collect, use, and protect your information.

The online store operates under the commercial brand name Omayna.

All purchase contracts concluded through this website are entered into with Teoma Ltd.

2. Eligibility

By using this website or placing an order, you confirm that:

  • you are at least 18 years old, and
  • you have the legal capacity to enter into binding contracts.

3. Products

The website offers products including:

  • handmade jewellery
  • gift boxes containing jewellery and other items
  • e-gift cards

Due to the handmade nature of many products, slight variations in colour, texture or finish may occur. Such variations are normal and do not constitute defects.

Product images are illustrative and slight differences from the delivered product may occur.

4. Customised and Made-to-Order Products

Certain products may be customised at the customer’s request, including variations in:

  • colour
  • size
  • design combinations

Customised products are usually produced within 5–10 working days, but production time may vary depending on workload and product complexity.

In accordance with Article 16(c) of Directive 2011/83/EU, the right of withdrawal does not apply to goods made according to the consumer’s specifications or clearly personalised.

Customised items therefore cannot be cancelled or returned once production has begun, except in the case of defects.

5. Orders and Contract Formation

Product listings on the website constitute an invitation to purchase.

A purchase contract is formed only after the seller confirms the order by email.

The seller reserves the right to cancel or refuse an order in cases including:

  • obvious pricing errors
  • suspected fraudulent activity
  • technical errors
  • product unavailability.

If payment has already been made, a full refund will be issued.

6. Prices and Currency

All prices displayed on the website are in EUR.

The seller is not registered for VAT, therefore no VAT is charged.

Prices displayed represent the final price payable by the customer, excluding shipping costs unless otherwise indicated.

Shipping costs are displayed before checkout.

6.1 For orders delivered outside the European Union (e.g., UK, Norway, Switzerland), the customer may be considered the importer and may be required to pay import duties, taxes, and customs clearance fees. These charges are not included in the price and are the sole responsibility of the customer.

7. Payment Methods

  • Google Pay
  • Cash on Delivery (COD), where available.

Payments are processed securely by third-party payment providers.
The seller does not store payment card details.

8. Shipping and Delivery

Orders are delivered using courier services such as Speedy, DHL or equivalent providers.

  • courier delivery to address
  • delivery to courier office or pickup point
  • parcel locker delivery.

Available delivery methods depend on the destination country and are displayed at checkout.

Delivery times are estimates and may vary due to circumstances beyond the seller’s control.

9. Free Shipping Policy

Free shipping may be offered under the following conditions:

  • Bulgaria: free shipping for orders over €80
  • European destinations: free shipping for orders over €200

Free shipping thresholds may change from time to time and will always be displayed on the website before checkout.

10. Transfer of Risk

The risk of loss or damage to goods passes to the customer when the customer or a third party designated by the customer takes physical possession of the goods.

11. Right of Withdrawal

Consumers have the right to withdraw from the purchase contract within 14 days without giving any reason.

The withdrawal period expires 14 days after the goods are received.

To exercise the right of withdrawal, the customer must notify the seller by email.

Returned goods must be sent back within 14 days after notification.

Return shipping costs are borne by the customer.

Refunds will be issued within 14 days after the returned goods are received and inspected.

12. Non-Returnable Products

The right of withdrawal does not apply to:

  • customised or personalised products
  • goods made according to the customer's specifications
  • products damaged after delivery due to misuse.

13. Defective or Non-Conforming Goods

Consumers are entitled to remedies for goods that do not conform with the contract under EU and Bulgarian consumer law.

Where a product is defective, the consumer may request:

  • repair
  • replacement
  • price reduction
  • refund where applicable.

The seller may request photographs of the defect.

Damage resulting from misuse, accidents, improper storage or failure to follow care instructions does not constitute a manufacturing defect.

14. Product Care and Safety

Handmade jewellery requires proper care.

Customers are advised to follow these guidelines:

  • put jewellery on after applying perfume or cosmetics
  • remove jewellery before sleeping or sports
  • avoid exposure to water and humidity
  • store jewellery in a dry place away from sunlight
  • clean jewellery using a soft dry cloth only.

Gift boxes may include products manufactured by third parties (such as scarves, soaps or candles). These products may have separate safety or care instructions provided by their manufacturers.

15. Gift Cards

Gift cards issued by the store:

  • are valid for 12 months from the date of issue
  • cannot be exchanged for cash
  • may only be used for purchases on the website.
  • expired gift cards are no longer redeemable.

16. Customer Accounts

Customers may create accounts on the website.

Account holders are responsible for:

  • maintaining the confidentiality of login credentials
  • ensuring the accuracy of their information.

The seller reserves the right to suspend accounts in cases of misuse or fraudulent activity.

17. Reviews and User Content

Customers may submit product reviews.

The seller reserves the right to remove content that:

  • is unlawful or defamatory
  • contains offensive language
  • infringes intellectual property rights
  • is misleading or fraudulent.

  • delays caused by courier or delivery services
  • losses resulting from misuse, improper care, or normal wear of products.

Nothing in these Terms shall limit or exclude liability where such limitation or exclusion is not permitted under applicable law, including liability relating to consumer rights under EU and Bulgarian legislation.

21. Force Majeure

The seller shall not be liable for delays or failure to perform obligations due to events beyond reasonable control, including:

  • natural disasters
  • strikes
  • transport disruptions
  • technical failures
  • supply chain interruptions.

22. Governing Law

These Terms are governed by the laws of the Republic of Bulgaria, together with applicable European Union legislation.

Consumers retain the protection of mandatory consumer laws in their country of residence.

23. Dispute Resolution

We will make reasonable efforts to resolve disputes amicably.

Consumers within the European Union may seek assistance through national Alternative Dispute Resolution bodies or the European Consumer Centres Network (ECC-Net).
